Following an application lodged and supported by the Legal Unit of the Greek Council for Refugees (GCR), concerning the prolongation of detention for an indefinite period of an Afghan citizen, after he had already been detained for 18 months, under the pretext of “an obligation to stay in a detention center”, the Athens Administrative Court of First Instance, ruled that the indefinite detention of migrants does not comply with the relevant legislation.

ECRE, the Greek Council for Refugees (GCR) and Aitima have sent a letter urging the Greek Ministry of Public Order and Citizen Protection to immediately withdraw the Decision 4000/4/59 of 28 February 2014 prolonging detention of migrants pending removal beyond the 18month limit set by the EU Returns Directive.

 THE COUNTRY REPORT

OF GREECE

General Introduction

Access to protection presumes access to a safe territory.

Asylum is a physical place where the person in need of protection finds security and safety. However, how to reach a safe place? There are barriers, material and virtual borders.

The situation of persons in need of protection has become more tangled since crossing European borders has been made more difficult, almost impossible, be- cause of the Schengen System which has erected an insurmountable wall around the external borders of the European Union.

Newsletter 04/2014

Administrative detention is a measure imposed under exceptional and case specific circumstances, for a prescribed period of time. As the European Court of Human Rights (ECtHR) has stated, in administrative detention “account should be taken of the fact that the measure is applicable not to those who have committed criminal offences but to aliens who, often fearing for their lives, have fled from their own country” (ECtHR, Amuur v. France, application no. 19776/92, 25.06.1996, § 43).

“Your Vote Can UNITE” – Campaigning Against Populism and Racism

7 Apr 2014 - 12 Apr 2014, near Athens, Greece

All over Europe, from Greece to Russia, from Georgia to Sweden, there is a rise of right-wing populist and extremist parties and movements.

They offer ‘easy solutions’ for the crises that many countries are facing. ‘Solutions’ like: terminating international agreements, leaving the EU, kicking out migrants, kicking out Roma and Sinti, kicking out… well, kicking out anyone who ‘looks’ or ‘acts’ differently.

The investigation concerning the boat wreck of 20th January 2014 near Farmakonisi, when 11 people lost their lives continues

The Greek Council for Refugees, together with many other national and international organisations have repeatedly denounced the illegal practice of refoulement of refugees (push-backs), which violates international refugee law, while also endangering human lives.

Following the boat wreck in Farmakonisi and the death of 11 people (3 women and 8 children), GCR demands that an end be put to the dangerous and illegal push-back practices on Europe’s maritime borders and calls for the creation of sufficient protection and reception conditions for those who seek international protection, according to national and European law.
