Δημοσίευση σχολίου σχετικά με την απόφαση 390/2013 του Μονομελούς Πρωτοδικείου Κω στο νομικό περιοδικό «Αρμενόπουλος» του Δικηγορικού Συλλόγου Θεσσαλονίκης (τεύχος Νοεμβρίου 2013).

Υπενθυμίζουμε ότι η εν λόγω υπόθεση αφορούσε στην έκδοση άδειας γάμου αλλοδαπού αιτούντος άσυλο, ο οποίος υποστηρίχθηκε από τη Νομική Υπηρεσία του ΕΣΠ.

Συζήτηση για την πρόσβαση στη διαδικασία ασύλου στη θάλασσα, στα σύνορα και σε τρίτες χώρες

Στη σκιά των πρόσφατων γεγονότων του ναυαγίου στο Φαρμακονήσι και το θάνατο τριών γυναικών και οκτώ παιδιών, πραγματοποιήθηκε την Δευτέρα 27 Ιανουαρίου στην Αίθουσα Τελετών του Δικηγορικού Συλλόγου Αθηνών (ΔΣΑ), η ανοιχτή συζήτηση που διοργάνωσε το Ελληνικό Συμβούλιο για τους Πρόσφυγες γύρω από το θέμα της πρόσβασης στη διαδικασία ασύλου σε ανοιχτή θάλασσα, στα σύνορα και σε τρίτες χώρες. Η  προγραμματισμένη εκδήλωση του ΕΣΠ αφορούσε στο σχολιασμό της απόφασης του ΕΔΑΔ Ηirsi Jamaa και λοιπών κατά Ιταλία., Έδωσε παράλληλα εκτενές βήμα για την ανταλλαγή απόψεων και προσεγγίσεων για τα γεγονότα της πρόσφατης τραγωδίας.

INTRODUCTION.

This report refers to the national legislation and the practices of the Greek Administration regarding the border controls and the procedure of asylum in the borders, as well as the access to the asylum procedure in areas far from the borders, where Greece exercises its extrajudicial authority. The above have been studied under the light of the Hirsi Jamaa and others versus Italy decision, which has been resolved by the European Court of Human Rights, and the obligations which imposes to the Members States such decision.

Προστασία (;) θυμάτων ρατσιστικής βίας

Πριν τρεις μήνες, Ιρανός μετανάστης έπεσε θύμα ρατσιστικής επίθεσης όταν τρεις μαυροφορεμένοι άντρες του δάγκωσαν και έκοψαν το αυτί. Το Ελληνικό Συμβούλιο για τους Πρόσφυγες (ΕΣΠ), στο πλαίσιο του Προγράμματος ENOUGH που υλοποιεί μαζί με τους ΓτΚ, ανέλαβε τη νομική υποστήριξη του θύματος προχωρώντας στην καταγγελία των δραστών στο Τμήμα Αντιμετώπισης Ρατσιστικής Βίας, ήδη από τις 18/10/2013 (τηλ. 11414).

Μετά την πρόκληση του ενδιαφέροντος των ΜΜΕ για τη συγκεκριμένη περίπτωση, οι αρμόδιες Αρχές αποφάσισαν, έστω και αργά, να εξετάσουν την εν λόγω καταγγελία.

Το Ελληνικό Συμβούλιο για τους Πρόσφυγες σας προσκαλεί σε συζήτηση σχετικά με την παρουσίαση της Έκθεσής του για την Ελλάδα σχετικά με την πρόσβαση στη διαδικασία ασύλου στα διεθνή ύδατα, στα σύνορα και σε τρίτες χώρες. Η Έκθεση αυτή συντάχθηκε ως απόρροια της απόφασης Ηirsi Jamaa και λοιπών κατά Ιταλίας, 23.12.2012, του Ευρωπαϊκού Δικαστηρίου των Δικαιωμάτων του Ανθρώπου, η οποία διευρύνει τις υποχρεώσεις των χωρών ως προς την παροχή διεθνούς προστασίας στα σύνορα και εκτός συνόρων. 

The murder of Shehzad Luqman was a hate crime

Athens, 7 January 2014. The trial for the murder of Shehzad Luqman resumes on Wednesday, 8 January 2014. The trial began on 18 December 2013 at the Mixed Jury Court of Athens. It is reminded that Shehzad Luqman, a 27 year-old worker from Pakistan, was murdered at Petralona (Athens) on 17 January 2013, as he was going to work on his bicycle. Christos Steriopoulos, 29, and Dionysis Liakopoulos, 25, riding on a motor bike and carrying butterfly knives, attacked and murdered him by stabbing him seven times. They were immediately arrested and confessed to their crime.

Following the arrest of the two perpetrators, a search was held at their place of residence, where Golden Dawn leaflets were found, as well as weapons similar to those used by organized vigilante groups committing acts of racist violence. Nevertheless, the authorities did not investigate possible connections to Golden Dawn neither did they attribute the murder to racist motives, but instead to a simple altercation. According to the lawyers of the victim’s family, it is evident from all the documents and exhibits in the case that it was a cold-blooded attack that corresponds to the operation of hit squads.

It is reminded that the Racist Violence Recording Network (RVRN) has recorded and analyzed more than 350 incidents of racist attacks since the beginning of its operation in 2011. According to the data that has been collected, the way in which this crime was carried out, the means that the perpetrators used, as well as their readiness to act, are similar to the modus operandi found in racist attacks committed by the so-called “organized hit squads”. Thus, this specific crime bears characteristics that classify it within the cycle of organized racist violence and criminality.

Furthermore, it is reminded that the RVRN had recorded the specific incident and had urged the Greek authorities to take measures for the adequate investigation of possible racist motives in the acts related to the criminal prosecution.

The Racist Violence Recording Network follows with great interest the course of the trial and expects that during the sentencing stage the court will take into account the aggravating circumstances provision of the Criminal Code [article 79(3)] referring to acts “caused by hatred due to race, skin color, religion, genealogical origins, national or ethnic origins, sexual orientation or gender identity”. The RVRN also expects the court to take into consideration the fact that the victim’s lawyer has no right to argue at this stage.

It is also reiterated that there is a need for immediate legislative initiatives so that racist or other bias motivations are included in the legal substance of the crime. The Greek State should also ensure that law enforcement authorities document any possible racist or other bias motivation reported by victims or witnesses, already since the lodging of a complaint.

1.     Οι παρεμβάσεις του ΕΣΠ:

Α. Γραπτή παρέμβαση της Νομικής Υπηρεσίας του ΕΣΠ προς το Συνήγορο του Πολίτη και τις αρμόδιες αρχές σχετικά με το πρόβλημα της πρόσβασης στα κρατητήρια.

Το Ελληνικό Συμβούλιο για τους Πρόσφυγες (ΕΣΠ) πραγματοποιεί επισκέψεις σε κέντρα κράτησης ανά την Ελλάδα προκειμένου να παράσχει νομική συνδρομή σε υπηκόους τρίτων χωρών οι οποίοι χρήζουν διεθνούς προστασίας. Στο πλαίσιο αυτό, η Νομική Υπηρεσία (ΝΥ) του ΕΣΠ πραγματοποίησε σειρά εκτάκτων αποστολών κατά τη διάρκεια του 2013, με σκοπό την ενημέρωση και την παροχή νομικής συνδρομής σε κέντρα κράτησης σε διάφορα σημεία της χώρας (Σάμος, Λέσβος, Παρανέστι, Κομοτηνή, Ξάνθη κλπ).

Ωστόσο,  η απρόσκοπτη πρόσβαση, επικοινωνία και συνεργασία των μελών της Νομικής Υπηρεσίας με τους υπό διοικητική κράτηση υπηκόους τρίτων χωρών εμποδίστηκε επανειλημμένα με αποτέλεσμα να καθίσταται εξαιρετικά δυσχερής έως αδύνατη μεταξύ άλλων η ενημέρωση των κρατουμένων σχετικά με τη διαδικασία ασύλου, η παροχή νομικής συνδρομής, ο εντοπισμός ευάλωτων περιπτώσεων (πχ. ενήλικοι εσφαλμένως καταγεγραμμένοι ως ενήλικοι).
