ECRE, GCR and Aitima have also called on the European Commission to press for the immediate withdrawal of the Ministerial Decision as well as any individual decisions taken in violation of the EU Return Directive. Moreover, and infringement procedure should be launched if no immediate action is taken by Greece to stop these breaches of EU law.
It is important to remember that the Ministry of Public Order’s implementation of the recent Opinion of the Legal Council of the State means that detainees already held for 18 months are forced to indefinite stay in detention centres which are defined as their place of residence.
